What Are New Jersey’s Drug Trafficking Penalties

Surprisingly, New Jersey drug trafficking penalties are loosely connected to the tragic death of basketball phenom Len Bias in 1986. At a draft party, Bias reportedly used cocaine, laid down, and died. Since 1986 was an election year, officials across the nation were under pressure to “do something” about drug dealers.

Public attitudes have shifted since then. Recreational marijuana is now decriminalized in New Jersey, but strict laws for other controlled substances remain and the harsh laws passed in the late 1980s and early 1990s remain in effect.

New Jersey drug trafficking penalties depend on the type of drug, the quantity involved, prior convictions, and other factors. Maximum exposure can include long state prison terms and serious collateral effects. In this post, a South Jersey drug trafficking attorney explains likely sentences and penalties and what to expect from the legal process.

Understanding New Jersey Drug Trafficking Laws

New Jersey prosecutes manufacturing, distribution, and possession with intent to distribute controlled dangerous substances. Exposure increases based on the drug category and weight. On top of that, separate offenses can apply in so called drug free zones, including within 1,000 feet of school property and within 500 feet of certain public property. Charges in these zones are filed in addition to any base distribution charge.

New Jersey Crimes by Degree and Typical Maximum Fines

Important: Certain drug distribution offenses allow substantially higher fines than the ordinary maximums. For example, first degree heroin or cocaine distribution can carry a fine up to $500,000, and first degree methamphetamine or marijuana offenses can carry a fine up to $300,000 under the statute.

Drug Free Zone Enhancements

School property or school bus within 1,000 feet: Distribution in this area is a separate third degree offense with a mandatory term of imprisonment in addition to any sentence for the underlying distribution charge.

Public housing facility, public park, or public building within 500 feet: Distribution in this area is also a separate offense that does not merge with the base distribution charge.

Marijuana Distribution Penalties

Adults 21 and older may possess up to six ounces of cannabis in New Jersey. Distribution is still tightly regulated and limited to licensed businesses. For criminal charges, more than one ounce but less than five pounds of marijuana is generally a third degree crime. Amounts between five and twenty five pounds are a second degree crime. Twenty five pounds or more is a first degree crime. Small amounts at or below one ounce can implicate lesser offenses or civil penalties depending on factors such as remuneration and prior history.

Prescription Painkiller Distribution Penalties

Prescription legend drug cases are common. New Jersey grades distribution as follows under N.J.S.A. 2C:35-10.5:

  • Four or fewer dosage units without payment can be charged as a disorderly persons offense.
  • Four or fewer units for money is a fourth degree crime.
  • Five to ninety nine units is a third degree crime.
  • One hundred units or more is a second degree crime.

Heroin and Cocaine Distribution Penalties

These drugs carry higher exposure than marijuana due to potency and risk. Under N.J.S.A. 2C:35-5, distribution or possession with intent to distribute is graded by weight including any adulterants or dilutants as follows:

  • Less than one half ounce is a third degree crime.
  • One half ounce or more but less than five ounces is a second degree crime.
  • Five ounces or more is a first degree crime and may include a fine up to $500,000.

Methamphetamine Distribution Penalties

Meth is cheap, powerful, and highly addictive. New Jersey imposes severe penalties under N.J.S.A. 2C:35-5:

  • Less than one half ounce is a third degree crime, with a possible fine up to $75,000.
  • One half ounce or more but less than five ounces is a second degree crime.
  • Five ounces or more is a first degree crime, and the statute permits a fine up to $300,000.

The Real-Life Impact of Drug Trafficking Charges

Beyond the prison terms and steep fines that New Jersey law allows, a drug distribution conviction can alter nearly every aspect of your life. Judges may impose mandatory parole ineligibility periods that limit your ability to seek early release. School zone and public property charges often add extra exposure on top of the base offense, making sentences even longer.

The collateral consequences can be just as damaging as the criminal penalties. A conviction on your record can affect your career opportunities and professional licenses, and it may prevent you from securing housing. Non-citizens can face serious immigration issues, including removal proceedings. Even everyday matters like applying for financial aid, obtaining certain loans, or maintaining custody arrangements can be impacted.

There are real defenses in state or federal trafficking cases. Procedural defenses address Fourth and Fifth Amendment violations, such as detentions without reasonable suspicion or arrests without probable cause. Substantive defenses focus on proof of the drug and the weight. Affirmative defenses can include entrapment or coercion, but both are rarely viable.
